§ 6-34. Operating hours, etc.

  • (a)

    No person operating under a license as set forth under this article, or his agents or employees, shall permit any of the following, at any time or times, except as permitted under this section:

    (1)

    Keep their premises open for business;

    (2)

    Admit the public to or permit the public to remain in, at, or upon, their premises;

    (3)

    Offer for sale at retail and/or deliver any alcoholic beverage on their premises.

    (b)

    All persons operating under a license issued under this article may open their premises to the public only between 6:00 a.m. and 1:00 a.m. (i.e. early morning of the next day) Sunday through Thursday. On Friday and Saturday persons operating under a license issued under this article may open their premises to the public only between 6:00 a.m. and 2:00 a.m. (i.e. early morning of the next day). License holders may apply for a special permit from the Liquor Commissioner for other days, such as Holidays or Special Events. The request must be made 24 hours in advance.

    (c)

    Nothing contained in this chapter shall prohibit the sale of food or serving of meals in restaurants holding a [any] license on Sundays provided patrons or guests do not have access to the bar, barroom or cocktail lounge or are not served alcoholic liquor on Sunday earlier than 12:00 noon nor later than 12:00 midnight.

    (d)

    It shall be lawful for any person holding a license under this article to sell or offer for sale at retail alcoholic liquor for consumption until the hour of 2:00 a.m. on January 1 of any year.

    (e)

    In all cases where, in the opinion of the liquor commissioner, the public peace is likely to be endangered by the keeping open of premises licensed hereunder, the liquor commissioner may issue his proclamation, under the seal of the village, commanding and enjoining all persons licensed by the village to sell alcoholic liquor, and their servants and agents to close their shops and places of business for such time as the liquor commissioner deems necessary, and neither to sell, give away, or suffer to be drawn, any alcoholic liquors in or about their premises during the times mentioned in the proclamation.

    (f)

    Music, or other amplified sound, audible from the exterior of any premises operating under any class of license as set forth in this article shall:

    (1)

    Only be allowed until 12 o'clock midnight on Friday and Saturday evenings, and until 10:00 p.m. on any other evening; and

    (2)

    Shall be in compliance with the noise provisions of the Village Code.
