§ 26-6. Fireworks permit.

  • (a)

    This section shall be cited as the fireworks use ordinance. Unless otherwise defined herein, all terms in this ordinance shall have the same meaning as used in the Illinois Fireworks Use Act ("the Act"), 425 ILCS 35/1, et seq., as amended from time to time.

    (b)

    It shall be unlawful for any person, firm, partnership, corporation, or other entity (collectively, "person") to possess, offer for sale, expose for sale, sell at retail, or use or explode any fireworks whether for public or private display, without a valid permit issued by the village.

    (c)

    The village board shall retain sole discretion to issue or deny a permit for the use of fireworks. Any person desiring to obtain a permit for the use of fireworks for public or private display shall file with the village clerk a written application in the form provided by the clerk and pay the permit fee of $25.00. Upon written request submitted with a permit application, the village board may waive the permit fee in the board's sole discretion. In order to be considered by the village board, a permit application must include, in addition to any information required on the clerk's form, the following:

    (1)

    The legal name, address and telephone number of the person requesting the permit, and in the case of a partnership, corporation, or similar entity, the name(s) of such officers, directors, managers, or other individuals with legal authority to bind such entity;

    (2)

    Proof of appropriate licensing of the applicant by the State of Illinois, the Illinois Fire Marshall, or any other governing or regulatory body with appropriate jurisdiction of such matters;

    (3)

    Proof of insurance according to Illinois statute and the rules, regulations, and guidelines of the Illinois Fire Marshall, except that the village board may require additional insurance coverage in the board's sole discretion prior to granting a permit;

    (4)

    The date and time of the intended use or display of fireworks, and if applicable a rain date in the event of inclement weather;

    (5)

    The location of the intended use or display of fireworks;

    (6)

    A general description of the type of fireworks to be used and the expected duration or extent of the display; and,

    (7)

    Written proof that the display site has been inspected and approved according to the Act, and any rules and regulations adopted pursuant thereto, and any rules and regulations adopted by the village fire protection district. Such proof shall include proof of payment for any fee(s) required by an inspecting officer.
